At American Wild Horse Conservation (“AWHC”), our mission is to preserve and protect America's wild horses and burros in free-roaming herds and safeguard their habitat through public awareness, educational programs, coalitions, and strategic partnerships. Through these endeavors, we are committed to ensuring the privacy of your personal data (defined below). By understanding how we collect, use, and share your personal data, you can feel confident in your support of AWHC and our mission. Here are some things you should know: 

  • We limit the personal data we collect and retain. We only collect personal data needed to provide you with updates on our efforts to save wild horses and opportunities for you to take action to help them, or with your permission. We only retain your information for the period of time necessary to fulfill the purposes for which we collected it, including delivering requested products and services, protecting the interests of our users and other stakeholders, and for the period of time required by law.

  • We provide ways for you to take charge of your personal data and express your preferences. We want to put you in control when it comes to your information, which is why we offer different ways for you to exercise control over your personal data, including providing you with choices about providing us your personal data and exercising communications preferences.

  • We will continue to be transparent with you about our data practices. We know it is important that you be aware of how and why your personal data is collected, used, and disclosed by us. Our Privacy Policy is meant to help you understand our data practices. If we change our data practices, we will update our Privacy Policy and let you know via email and/or a prominent notice prior to the change becoming effective

This Privacy Policy outlines our data practices and is intended to help us maintain transparency and accountability in all our operations. Your trust is paramount to us, and this document is a testament to our commitment to safeguarding your personal data. 

This Privacy Policy is designed to inform our donors, supporters, and all those who engage with us via our website americanwildhorse.org and all related websites (our “Sites”), and any other technologies, features, content, and services we offer (collectively, our “Services”), ensuring that we can continue our vital work with the utmost integrity and trust.

This Privacy Policy incorporates our Terms of Service. To keep things simple, any capitalized terms not otherwise defined in this Privacy Policy have the meanings given to them in our Terms of Service.

This Privacy Policy does not apply to third-party websites, products, or services, even if they may link to our website or if our site links to them. We recommend that you review the privacy practices of those third parties before accessing third party websites and sharing any personal data.

Types of Personal Data Collected

“Personal data” means that information identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identifiable individual. 

Data You Provide Us

While using our Services, we may ask you to provide us with certain personal data that can be used to contact or identify you. Personal data may include, but is not limited to:

  • Email address
  • First name and last name
  • Phone number
  • Address, State, Province, ZIP/Postal code, City

Data We Collect Automatically

Usage Data is collected automatically when using the Services. Usage Data may include information such as your device's Internet Protocol address (IP address), browser type, browser version, the pages of our Sites that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

When you access the Sites by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers, and other diagnostic data.

We also use cookies and similar tracking technologies to track the activity on our Sites and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze our Services. We also may collect information about your online activities on websites and connected devices over time and across third-party websites, devices, apps, and other online features and services. Data We Collect From Others 

We may also collect personal data from the following entities or individuals: 

  • Our service providers. We may collect personal data from our service providers, including communications and customer and technical support providers.
  • Third party marketing partners. We may also obtain lists of individuals who have shown an interest in topics related to AWHC from third-party sources. This helps us reach out to potential supporters who might be interested in our cause.
  • Analytics and advertising partners. We may collect personal data from our analytics and advertising partners and providers, including online advertising networks and analytics providers. 
  • Social media and other content platforms. We may collect personal data from platforms such as Facebook, X, Instagram, YouTube, or Google if you interact with us on these platforms to use the Sites or Services.  
  • Donor Management Platform. Our primary donor management platform is operated by Bonterra, and donor information is primarily stored within EveryAction, a product provided by Bonterra. For more information on how Bonterra handles personal data, please refer to their Privacy Policy.
  1. Using Your Personal Data

We may use personal data for the following purposes:

  • To raise awareness and funds: Including to monitor the usage of our Services and to understand the effectiveness of our campaigns.
  • To contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication regarding updates, advocacy actions, and informative communications related to our mission.
  • To provide you: With news, special offers, and general information about our campaigns, events, and initiatives unless you have opted not to receive such information.
  • To manage your preferences: To allow you to manage your subscription and privacy preferences through a self-service portal.
  • For targeted advertising. We use behavioral remarketing services to advertise on third-party websites to you after you have visited our Sites. We and our third-party vendors use cookies to inform, optimize, and serve ads based on your past visits to our Services.   • For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our Services, campaigns, and your experience.

Anonymized, Aggregated, and Deidentified Data 

We may create anonymized, aggregated, or de-identified data forms of personal data to better understand the topics and content that you would be interested in receiving. This data is always non-identifiable when being processed but the outputs are used to enrich your profile in our donor management system. Our use of aggregated, anonymized, and de-identified data is not subject to this Privacy Policy 

  1. Disclosing Your Personal Data

We may disclose your personal data in the following situations:

  • With service providers: We may share your personal data with Service Providers to monitor and analyze the use of our Service, to contact you, and to manage our donor information.
  • With affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent organization and any  other subsidiaries, joint venture partners, or other organizations that we control or that are under common control with us. 
  • With business partners: We may share your information with our business partners to offer you certain campaigns, services, or promotions.
  • With other users: When you share personal data or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed.
  • For legal compliance or harm prevention. Under certain circumstances, we may disclose your personal data if required to do so by law or in response to valid requests by public authorities. We may also disclose your personal data to (i) protect and defend our rights and property; (ii) prevent and investigate possible wrongdoing in connection with the Services; (iii) protect the safety of our customers and employees; or (iv) protect against legal liability. 
  • Business transfers and transactions.  If we are involved in a merger, acquisition, asset sale, or other corporate combination, your personal data may be transferred to the acquiring or surviving entity.  
  • With your consent: We may disclose your personal data for any other purpose with your consent.

  1. Cookies and Other Tracking Technologies 

A cookie is a piece of data contained in a very small text file that is stored in your browser or elsewhere on your hard drive. Cookies allow AWHC to identify your device as you navigate through our Sites. We also use them to recognize return visitors to the Sites. This helps make navigating and interacting with the Sites more efficient, easy, and meaningful.  AWHC uses both session and persistent cookies. Session cookies are cookies that disappear from your computer or browser when you turn off your computer. Persistent cookies stay on your computer even after you’ve turned it off.

Types of Cookies We Use

  • Strictly Necessary Cookies

Strictly necessary cookies make it possible for you to access our Sites, navigate within the Sites, and access information related to your account.  Each time you log into the Sites, a cookie containing an encrypted, unique identifier that is tied to your account is placed on your browser. These cookies allow AWHC to uniquely identify you when you are logged into the Sites and to process your online transactions and requests.

  • Functionality Cookies

Functionality cookies allow the Sites to remember information you have entered or preferences you select and provide enhanced, more personal features. These cookies allow you to optimize your use of AWHC’s Sites after logging in. These cookies can also be used to remember changes you have made to text size, fonts, and other parts of web pages that you can customize.

  • Performance Cookies

These cookies collect data about how visitors use the Sites. This includes data like which pages visitors go to the most. Third-party service providers that currently place performance cookies include:

  • Google Analytics: We use Google Analytics to help analyze which pages on the Sites visitors to the site viewed. For more information on opting out of Google Analytics, click here.

  • Targeting or Advertising Cookies

AWHC may have third-party service providers track and analyze usage and volume statistical information from those who visit our Sites. AWHC sometimes uses cookies placed by its third-party service providers to track the performance of our advertisements. These cookies remember which browsers have visited the Sites. This data given to the third-party service providers does not include information that identifies you specifically, but this data may be re-associated with information that identifies you specifically after AWHC receives it.

To learn more about how to opt out of targeting and advertising cookies, you can go to the Your Online Choices page, the Network Advertising Initiative page, and the Digital Advertising Alliance’s Consumer Choice page. These opt-out tools are provided by third parties, not AWHC. We do not control or operate these tools or the choices that advertisers and others provide through these tools.

Advertising Networks

AWHC also uses third-party advertising networks that collect IP addresses and other data from web beacons on the Sites, from emails, and on third-party websites. Ad networks follow your online activities over time through automated means, such as cookies and web beacons. They use this data to provide ads about products and services tailored to your interests.

  • Meta Ads (Facebook / Instagram): We use Meta Ads to track how you use the Sites and target ads to you on Facebook and Instagram. For information on how to opt out of Meta Ads tracking technologies, click here.
  • Google Ads: We use Google Ads to track our support conversion metrics for our search engine marketing campaigns. For more information on opting out of Google advertising tracking technologies, click here.

Web Beacons

We use web beacons along with cookies to gather data about the use of the Sites and interaction with emails from AWHC. Web beacons are clear electronic images that can recognize certain types of data on your computer, like cookies, when you view a particular website tied to the web beacon, and a description of a website tied to the web beacon. For example, we may put web beacons in marketing emails that notify us when you click on a link in the email that directs you to one of the Sites or one of its pages. We use web beacons to operate and improve the Sites and email communications.

IP Addresses

When you visit the Sites, or use our products and services, we collect your IP addresses to track and analyze information about the devices that are connecting to our systems and about where those devices are located. For example, we use IP addresses to track which regions visitors to our website come from and to detect possible fraud.

Retention of Your Personal Data

We will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.

Security of Your Personal Data

The security of your personal data is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

Security of Your Credit Card Information

We use secure server software (SSL) that is the industry standard for secure commerce transactions. It encrypts all of your personal data, including credit card number, name, and address, so that it cannot be read as the information travels over the Internet.

  1. Transfer of Your Personal Data

If you provide us with your personal data when using the Services, please note that we are headquartered in the United States. To provide and operate our Services, it is necessary for us to process personal data in the United States.

This means that this information may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. Your personal data will not be transferred to an organization or a country unless there are adequate controls in place to protect your data and other personal information.

Marketing and Communications

We may use your personal data to contact you with newsletters, marketing or promotional materials, and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us.

Advertising

You may be able to opt out of receiving ads that are personalized ads served by our Service Providers by changing your preferences, as outlined in Cookies and Other Tracking Technologies. The opt-out will place a cookie on your computer that is unique to the browser you use to opt out. If you change browsers or delete the cookies saved by your browser, you will need to opt out again.

Your mobile device may also give you the ability to opt out of the use of information about the apps you use in order to serve you ads that are targeted to your interests:

  • "Opt out of Interest-Based Ads" or "Opt out of Ads Personalization" on Android devices
  • "Limit Ad Tracking" on iOS devices

You can also stop the collection of location information from your mobile device by changing the preferences on your mobile device.

"Do Not Track" Signals 

Various browsers allow a “do not track” (DNT) setting that relies on a technology known as a DNT header, which sends a signal to websites visited by the individual about the individual’s browser DNT setting. At this time, there is no general agreement on how companies like AWHC should interpret Do Not Track signals. Therefore, AWHC does not currently commit to respond to DNT signals, whether that signal is received on a computer or on a mobile device. AWHC does, however, provide meaningful choices to you about the information that is collected through cookies and web beacons through the various opt-out options set forth above. We will continue to monitor developments around DNT browser technology and the implementation of a standard. 

  1. Notice for Nevada Residents

We do not “sell” personal data as that term is defined under Nevada law, but Nevada residents have the right to request to opt out of any future sale of their personal data under Nevada SB 220. If you are a Nevada resident and would like to make such a request, please contact us. You must include your full name, email address, and postal address in your email or mail request so that we can verify your Nevada residence and respond. In the event we sell your personal data after the receipt of your request, we will make reasonable efforts to comply with such request.

  1. Notice for Colorado, Maryland, and Oregon Residents 

This Privacy Notice contains additional information for residents of Colorado, Maryland, and Oregon regarding personal data that we collect, how we use it, what sources it is derived from, and who we disclose it to, and provides information regarding your rights, and our responsibilities, under applicable laws and regulations. The provisions contained within this section are intended to provide notices in compliance with the Colorado Privacy Act (“CPA”), the Maryland Online Data Privacy Act (“MODPA”), and the Oregon Consumer Data Privacy Act (“OCDPA”). 

Our Personal Data Practices 

The CPA, MODPA, and OCDPA provide now, or will in the future provide, rights to residents of Colorado, Maryland, and Oregon, respectively, to receive certain disclosures and access regarding collection, use, sale, and sharing of personal data. More detail about what kinds of personal data we may collect or have collected, how we collect it, why we collect it, and who we may disclose it to is found in Sections 1, 2, and 3.  

We may “sell” and/or “share” personal data with third party advertising networks and platforms for purposes of providing targeted behavioral advertising on those platforms.

Your Privacy Rights

If you are a resident of Colorado, Maryland (beginning October 1, 2025), or Oregon, you have or will have the following rights under applicable law in relation to your personal data, subject to certain exceptions: 

  • Right to Know and Access. You have the right to know what personal data we collect, use, disclose, and/or sell or share as those terms are defined under applicable state law. You may ask us to provide you a portable copy of this information up to two times in a rolling twelve-month period.
  • Right to Delete. You have the right to request under certain circumstances that we as well as our service providers and contractors delete the personal data that we collect about you.
  • Right to Correct Inaccurate Personal Data. You have the right to request the correction of inaccurate personal data.
  • Right to Opt Out. You have the right to opt out of our processing of your personal data for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. Please note that we do not use your personal data for sales or profiling. 
  • Rights Concerning Sensitive Personal Data. If you are a resident of Colorado or Oregon, we cannot process your sensitive data or your sensitive data inferences or use your personal data for certain purposes without your affirmative consent. If you are a resident of Maryland, we can only collect, process, or share sensitive data if it is strictly necessary to provide or maintain a specific product or service requested by you. We do not collect, process, or share “sensitive data” as that term is defined by the CPA, MODPA, or OCDPA.  
  • Right to Non-Discrimination. You have the right not to receive discriminatory treatment for the exercise of the privacy rights described above.

How To Exercise Your Privacy Rights

Please use the following information to exercise your privacy rights. Please note that any request you submit to us is subject to an identification and residency verification process as permitted under applicable law, as well as certain other procedural requirements that may be noted in the sections below. Additionally, all requests are subject to certain exceptions under applicable law, which may vary.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, manifestly unfounded, or in accordance with applicable law. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Depending on applicable law, you may be limited in how many verifiable or authenticated consumer requests you make within a twelve (12) month period. If we have collected information on your minor child, you may exercise the above rights on behalf of your minor child. Additionally, in some jurisdictions, you may designate an authorized agent to submit a request on your behalf, and if so, we may require proof of the agent’s authorization by you and/or verification of the agent’s own identity. 

Except where otherwise noted, we will respond to your request within forty-five (45) days after receipt and we reserve the right to extend the response time by an additional forty-five (45) days when reasonably necessary and provided consumer notification of the extension is made within the first forty-five (45) days.

How To Appeal Decisions About Your Rights

Colorado, Maryland, and Oregon residents can appeal our decisions concerning privacy rights requests as follows:  

  • Colorado residents. If you are a Colorado resident and want to appeal our decision with regard to a request that you have made, please contact us using the information in Section 13. Within forty-five (45) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including an explanation of our reasons in reaching the decision. If the appeal is denied, you may contact Colorado’s Office of the Attorney General by phone at (720) 508-6000 or by submitting a form here.  
  • Maryland residents. If you are a Maryland resident and want to appeal our decision with regard to a request that you have made, please contact us using the information in Section 13. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including an explanation of our reasons in reaching the decision. If the appeal is denied, you may contact Maryland’s Office of the Attorney General by phone at (888) 743-0023 or by submitting a form here.  
  • Oregon residents. If you are an Oregon resident and want to appeal our decision with regard to a request that you have made, please contact us using the information in Section 13. Within forty-five (45) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including an explanation of our reasons in reaching the decision. If the appeal is denied, you may contact Oregon’s Office of the Attorney General by phone at (877) 877-9392 or by submitting a form here.  

  1. Children's Privacy

Our Services do not address anyone under the age of 13. We do not knowingly collect personal data from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.

Our Services may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the privacy policy of every site you visit.
